Building an ADU in Los Altos

The most generous city on paper: ADU building-permit, plan-check and MEP fees are all $0 in the FY2026-27 schedule, and the city gives away nine permit-ready detached plan sets. The trade-offs are a 16 ft one-storey cap on detached units in the code, a daylight plane, and a recorded deed restriction on every ADU.

Local rules worth knowing

  • Maximum size. Detached 850 sq ft (one bedroom) or 1,200 sq ft (two or more), basement included, garage excluded; attached units also capped at 50% of the main home.
  • Height. Code: detached one storey and 16 ft. The city's information guide lists 18 ft; state law allows 18 ft near transit. Confirm with planning.
  • Daylight plane. 8 ft at the property line rising at 6:12; 5 ft separation from the main home and other structures (waived if it would block an 850 sq ft unit).
  • Deed restriction. Every ADU records a deed restriction barring short-term rental and separate sale before the building permit issues.
  • JADU. Owner must live in the main home or the JADU; deed restriction required; no separate utility connection or fee.
  • Parking. One uncovered space for a new-construction ADU unless a state exemption applies.
  • Ordinance vintage. Chapter 14.14 is the 2020 ordinance and still cites the old code sections; state changes since then control where more permissive.
