Building an ADU in Unincorporated Santa Clara County

For rural parcels the gating items are usually outside Planning: a septic clearance from Environmental Health and the County Fire Marshal's water-supply and driveway standards. The County's free 800 and 1,200 sq ft plan sets are the cheapest path but are off-limits in fire, flood or geologic-hazard zones.

County-owned plans free of charge: 800 sq ft two-bed and 1,200 sq ft three-bed, each in two styles. Staff review only the site-specific items (about four weeks first review, two on resubmittal). Not usable in WUI, flood or geologic-hazard zones. Under state law a detached unit built from a pre-approved plan gets a 30-day decision instead of 60.

Local rules worth knowing

  • Authority. Land outside any city's limits is permitted by County Planning & Development with the County's own standards, not the nearest city's.
  • Septic. Environmental Health must clear a unit on septic: a scaled as-built site plan of the tank and leach field, a pumper's report from the last three years, and a water test; the drainfield is sized by bedrooms.
  • Fire and water. County Fire Marshal standards: fire-protection water supply or approved sprinklers, driveway specifications, and a water source within 150 ft of the structure.
  • Size and height. The 2023 ordinance caps a detached unit at 1,200 sq ft and two units at 1,700 sq ft combined, with a 16 ft height cap in some cases; HCD found parts non-compliant in June 2025 and an amendment is pending (hearing listed for November 2026). State law controls where more permissive.
  • Movable tiny homes. One movable tiny home per lot is allowed in lieu of a standard ADU.
